Estate administration refers to the process where a person’s estate is process and distributed according to whatever instrument is in effect at the time of the person’s death. If a person dies and has a valid will, then they are said to have died “testate”. So the will instrument will be filed with the appropriate court and the decedent’s estate handled according to the will.
If a person dies without a will or trust, they have died “intestate” and their estate will be distributed according to the laws of the state in which the person died. These may not be very favorable to the decedent’s family.
Estate planning is essential to make the estate administration process as simple as possible.
